Yard waste is collected from the curb once a week on your scheduled collection day, provided that the materials meet preparation requirements. Yard waste is made into mulch and compost for reuse. Note: As of 2023, residents must use paper yard waste bags or reusable containers weighing no more than 75 pounds when preparing leaves and grass clippings for yard waste collection. Loose debris (i.e. limbs and branches) will be collected. Residents can pick up bags at 1200 Otts St. Monday through Friday from 8 a.m. to noon and 1 p.m. to 3:30 p.m. while supplies last. The goal of Overlook is to remain a natural environment and maintain existing canopy wherever possible, and the ACC guidelines are written as such. With that said, there are certain limited removals that take place without an ACC application. Tree pruning (limbing), removal of trees 2” or less in diameter (measured at a height of 2’) and not in the lake buffer, and replacement of 4 or less shrubs do not require ACC approval. To be safe, when in doubt, request ACC approval!

The Architectural Control Committee (ACC) or Architectural Review Committee (ARC) maintains compliance with the architectural, landscape and lake buffer guidelines for Overlook on Mountain Island Lake

Section 4.17 of the ALG’s regarding fences states:
The location, materials, size and design of all fences and walls must be approved in advance
in writing by the ACC prior to installation. The majority of approved fence materials have been
decorative iron type and split rail. Additional high quality fence types will be reviewed and
considered for approval by the ACC on an individual application basis. Chain link, welded wire, or
white PVC fencing will not be permitted, except as same may be installed within the Common
Areas by the Declarant or the Owners Association. Once an approved fence or wall has been
erected on a side Lot boundary line which is a common boundary line with another Lot, that
approved fence and material(s) will be the only approved fence and material(s) that may be
erected on that common Lot line. No double fencing will be allowed on side or rear Lot lines.
The identical fencing materials, type and color, must be used on the side and rear of a property as the
fencing materials facing the front elevation street view,
No fence or wall (including for this purpose densely planted hedges, rows or similar landscape
barriers) shall be erected, placed or maintained on any Lot nearer to any Roadway fronting such
Lot than the rear building corner* of the main dwelling constructed on such Lot (unless otherwise
approved in advance in writing by the ACC). No fence or wall shall be erected, placed or
maintained on a Lot in a location that will substantially obstruct views of the Lake. Fences and
walls shall not exceed six (6) feet in height*. All electronic fences for pet containment must be
buried

It is the goal of the ACC to review all requests as quickly as possible. If you have submitted a request and have not received a response within 30 days, please email overlook@braesael.com to request an update. According to the community ALG’s, the ACC has 30 business days to approve or deny a request in which all applicable documents have been submitted. After 30 business days have passed, the resident must submit in writing a “request to act” to the ACC. If after 10 business days have passed since the written “request to act” has been submitted, and the original 30 business days have also passed, and no approval or denial has been issued by the ACC, it shall
be conclusively presumed that the ACC has approved the request. Please refer to section 7.6 of the ALG’s for more detail.

The ACC is a small group of our own neighbors who volunteer their time to be sure projects are executed professionally and meet the ARCHITECTURAL, LANDSCAPE AND LAKE BUFFER GUIDELINES for our community. Our community management firm, Braesael Management Company, is the main contact when project approvals are requested. If a visit to the property is needed, an appointment will be scheduled and a member of the ACC will contact you directly. The ACC is always looking for volunteers to assist, particularly in the spring and summer months. Per Section 4.12 of the ALGs:

Mail and Newspaper Boxes
All mailboxes and newspaper boxes must be of a standard color, size, and design as approved by the ACC. In general, the size and design of all mailboxes and newspaper boxes should be substantially similar to those shown on Schedule D attached hereto.

Carolina Mailboxes Inc. at 3428 Vane Court, Charlotte, NC 28206, is the recommended source to maintain consistency of mailbox color, size, design, and style of numbering in Overlook. They can be contacted at 704-334-3393 or carolinamailboxes.com.

Homeowners are also responsible for the ongoing maintenance and upkeep of all mailboxes and posts.

To assist with compliance, an example of the approved mailbox design is attached. You can purchase the mailbox directly from Carolina Mailboxes using this link: Overlook Mailbox. The mailbox is named “Overlook.”

We also understand that residents may prefer a lockable mailbox for added security. The Overlook Architectural Control Committee (ACC) will approve a lockable mailbox like this one: Lockable Mailbox Example. An example of this mailbox is also attached. Please note that an application must be submitted for committee review prior to installation. Be sure to include the specific model number you plan to purchase in your application.
